Okotoks RCMP have laid charges against two men in respect to a fatal motor vehicle collision in May.

Around 1:00 a.m. on May. 6, Okotoks RCMP responded to the collision on Highway 2A just North of Okotoks.

Following the investigation by Okotoks RCMP, police allege just prior to the fatal collision a black Mercedes was witnessed racing a red motorcycle, both vehicles were allegedly moving at high speeds when the Mercedes collided with a southbound Toyota FJ Cruiser.

The driver of the FJ Cruiser, 43-year-old Daniel Tillapaugh of Okotoks, was killed as a result of the collision.

The driver of the Mercedes, 45-year-old Jody Sebryk, of Okotoks has been charged with:

Impaired Driving Causing Death; 
Impaired Driving Over 0.08 Causing Death; 
Dangerous Operation of a Motor Vehicle Causing Death; 
Dangerous Operation of a Motor Vehicle while Street Racing Causing Death; 
Criminal Negligence Causing Death while Street Racing.

The driver of the motorcyle, 25-year-old Benjamin Legere of Okotoks has been charged with:

Dangerous Operation of a Motor Vehicle Causing Death; 
Dangerous Operation of a Motor Vehicle while Street Racing Causing Death; 
Criminal Negligence Causing Death while Street Racing.

Both Sebryk and Legere are scheduled to appear in Okotoks Provincial Court on Sept. 29.
