More drama in the case of Eddie Maurice and Ryan Watson.

Watson fired the latest salvo after filing a new affidavit in court this week.

Both parties will be in a Calgary courtroom Thursday, January 16, with the Maurice's looking to have Watson's case dismissed following new legislation from the Province which retroactively makes it impossible for convicted criminals to sue their victims.

Jessica Maurice says they have their fingers crossed Watson's lawsuit gets tossed.

"That's what we're hoping for. Our lawyer says it could get tossed out or a decision is made, or it may be adjourned to another date or another hearing. I'm not completely sure."

In court documents filed Friday, January 10, Watson admits he and Stephanie Martens were looking for either loose change or gas at the Maurice residence, but at no time were they looking to break into anyone's home.

Further, Watson says Maurice fired five shots at him, narrowly missing his head at one point, something Jessica says never happened.

"One of the things he said is that Eddie shot directly at his head and he ducked to miss it and if he hadn't ducked he would have been shot in the head. That's not even physically possible when you're standing that close to somebody. You're not Superman. You can't just duck bullets like that. So some of the things that he said are quite unbelievable that he said in there."

Jessica Maurice says the fear they have now, is because Watson needs Eddie to be convicted criminally for his lawsuit to be successful, he's trying to introduce new evidence to make that happen.

"He wants to go down that path of trying to re-open the investigation or doing a private investigation to bring new evidence to the Crown or RCMP. And if they don't re-open the prosecution he's threatened to proceed with a "private prosecution," which I guess is very rarely done. And at that point that's basically his only option and that's what it sounds like he wants to pursue."

In a statement released by the Maurice's through their lawyer, they say they shouldn't have to go through another criminal proceeding.

"The Maurice's are now having to once again relive not only this incident, but also the trauma and fear related to the possibility of another criminal prosecution case against Edouard. It is clear that Watson will try anything to make money from the Maurice's and we hope to see an immediate dismissal of this case by the Court, and no further action by the Crown or RCMP regarding the original criminal matter."
