Another victory for those opposed to open pit coal mining on the eastern slopes of the Rockies.

The Supreme Court will not hear appeals from Benga mining and two First Nations who wanted to appeal a lower court's decision.

A review panel said earlier this year the effects of the proposed Grassy Mountain mine outweighed any economic benefits

Alberta's regulatory agency then denied Benga mining's permit applications.

Benga and the two area First Nations asked the Alberta Court of Appeal for leave to contest the decision but were denied which forced them to look to the Supreme Court.

The court did not give any reasons for refusing to take up the case.
